Abstract

This study has as main objective to analyze the effectiveness of rights in the elderly, based on the Federal Constitution of 1988, the National Policy of the Elderly and the Statute of the Elderly. It is a Bibliographic research, where from a series of scientific documents, we had to report the history of Brazilian population aging together with its legal frameworks and challenges. It was found after the research that there was a considerable growth of the elderly population in Brazil, but this growth must be added to improvements in the quality of life of this age segment, which is not fulfilled in its entirety. It was also shown that many rights were guaranteed in the Federal Constitution of 1988 in the National Policy of the Elderly and in the Statute of the Elderly, but it lacks the will on the part of the state to make them efficient public policies. There is also a lack of knowledge on the part of the elderly and society in general of the rights directed to this population group, which causes another challenge to be overcome.
